North Carolina District Court Judge Ronald Chapman declared a mistrial Wednesday for the three men accused of attacking NASCAR driver Mike Wallace, his daughter and son-in-law.

Paul Lucas, Nathan Lucas, and Randolph Mangum face misdemeanor assault charges following the June 17 attack at the PNC Music Pavilion.

WSOC reports two potential witnesses violated a sequestration order by being present in the courtroom during testimony Tuesday. It prompted the defense attorney to ask for the mistrial Wednesday because any future testimony they give could be influenced.

Those witnesses are being held in contempt of court.

No new trial date has been set.

Wallace and his family were attacked in the parking lot on the PNC Music Pavilion in Charlotte, North Carolina, following a Rascal Flatts’ concert. In an interview with WSOC following the attack, Wallace said he suffered a concussion, received 12 stitches, and lost three teeth.

A police report said all victims were kicked and punched in the head, face and stomach during the attack.
