Richard Childress Racing’s final appeal of penalties to Ryan Newman and his team will be heard at 8:30 a.m. May 6 at the NASCAR R&D Center, NASCAR confirmed Friday.

Childress is appealing penalties it received after NASCAR stated the team manipulated its tires during the March 22 Sprint Cup race at Auto Club Speedway.

The National Motorsports Appeals Panel reduced the points penalty to RCR and Ryan Newman from 75 to 50 points and reduced crew chief Luke Lambert’s fine from $125,000 to $75,000 but kept Lambert’s six-race suspension.

Lambert’s suspension has been deferred until after the final appeal. The upcoming appeal will be heard by Bryan Moss, the National Motorsports Final Appeals Officer. His decision is final.

Unlike the first appeal where the burden of proof was on NASCAR, the burden of proof switches to Richard Childress Racing. The rule book states an appellant must prove to Moss, president emeritus of Gulfstream Aerospace, by a “preponderance of the evidence” that a violation did not occur, the penalty assigned is not within the scope of the guidelines and/or that the appellant was denied their appellate rights.
